We have attention seeking Judges all the time. The Judge in the Anna Nicole deal freaked when they turned on the camera. We used to have a D.A. that everyone was warned never to be standing between him and a TV camera or you might be run over.

Creative judging?
I thought you had laws that stipulated penalties for different crimes, and not that it was totally up to the judge?
In this way the penalty for the same crime can totally depend upon which judge you have?

And have public humiliation as a part of the penalty?

But then again I am not a lawyer.

Now that there is over-crowding in most jails in the US, thanks to the "war on drugs" and its mandatory minimum sentencing laws, minor offenses like this can have alternate punishments that do not involve jail time.
Usually, for a first offense, it would be probation and community service.

This is a rather unusual punishment, however.

Judge Cicconetti's Sister, Amy, is an old partner of mine. Painesville is my hometown, and I have met Judge Cicconetti on multiple occasions. He's a really neat guy.

He hands down these types of sentences all the time, he loves the public humiliation route. The first big one he did was a guy who ran from the cops, so he was given teh choice of like 6 months or run in a local marathon. The catch was, he had to beat all the cops that were entered in the race or else he would end up serving the 6 months. They assigned him a parole officer who was a life long runner as a trainer. Apparently the guy was an addict too, but being forced to train like that got, and kept, him sober. Eventually he only lost to one of the cops out of the 30 that entered the race. The Judge only made him spend a week in jail then.



The reason it's only a blip on the WKYC (the Cleveland NBC station) is cause he hands out a couple of these types of sentences every week for the past 4 to 5 years. We all nod and smile and he's been re-elected since then. The guy's not looking for attention, he's just trying to get more effective punishments for minor crimes.

Im all for creative judging, but im just wondering how he gets away with this shit... when youve got one mizor gettin 6 months for something and another guy gettin off with a few weekends in a chicken suit for an identical crime, your startin to tread on thin ice, constitution-wise...and also, i was unaware that in the criminal courts (which are not courts of equity) there was this type of discretion in the first place...maybe everyone just likes the guy and no one says anything-- im pretty surprised someone hasn't made an issue outta this tho if its constatntly goin on....
